Estate Agent Law
The law for estate agents is to the greatest extend case law. Legal requirements concerning estate agent law are insubstantial at the moment. This makes dealing with it difficult, especially as the judicial authority adjudges regionally different. There are no clear legal requirements we can fall back on.
It is hard to ascertain if a commission is earned or not, even for expert practitioners. The realisation of entitlement to a commission is extremly difficult and always a question of the individual case. As a result, a profound knowledge of the estate agent law is as important as advising on the prospects in order to assert one´s alleged claims successfully.
The judical enforcement, for example the assertion or the redemanding of the entitlement to a commission, should be considered only if the entitlement promises chances of success and if it could be administred successfully. Whoever wants to throw good money after bad?
